Terms and Conditions

1. INTRODUCTION

These Terms and Conditions ("Terms") govern the use of the ACHWALE platform, owned and operated by KeTab Internet World (Proprietorship) ("ACHWALE," "we," "us," or "our"). ACHWALE operates a digital influencer marketing ecosystem connecting Brands, Creators, and Partners for transparent, performance-driven campaigns.

By registering or using ACHWALE in any manner, the user ("you" or "User") acknowledges that they have read, understood, and agreed to these Terms.

2. DEFINITIONS

Brand

A business or individual creating and managing marketing campaigns through ACHWALE to collaborate with Creators.

Creator

An individual or entity producing and posting campaign-related content on social media platforms such as Instagram, YouTube, or others approved by ACHWALE.

Partner (Agent)

An individual or business entity that brings Brands to the platform and assists in campaign execution.

Campaign

A marketing project initiated by a Brand through ACHWALE for promotion through one or more Creators.

Platform

Refers to the ACHWALE website, mobile application, or any other digital interface owned by KeTab Internet World.

3. ELIGIBILITY

Creators

Must have a minimum of 500 genuine followers on their registered social media account(s). Use of artificial followers or engagement manipulation will result in warnings or permanent suspension.

Partners

Must be at least 15 years of age and comply with ACHWALE's partner onboarding verification process.

Brands

Must be legally registered under their local jurisdiction and may optionally hold a valid GST registration.

General

Each User must create an account on ACHWALE; registration constitutes acceptance of these Terms.

4. USER OBLIGATIONS

Provide accurate, complete, and current information during registration and verification (KYC).

Maintain confidentiality of login credentials.

Use ACHWALE only for lawful purposes.

Not impersonate ACHWALE or collect payments outside the platform.

Abide by campaign rules, ethical marketing practices, and applicable social media platform policies.

Note:

ACHWALE reserves the right to suspend or terminate any account engaging in fraudulent, abusive, or unlawful activities.

5. KYC AND DATA COLLECTION

For operational and compliance purposes, ACHWALE collects the following from users:

  • Aadhaar card, PAN card, GST details (if applicable), and bank account information
  • Date of birth for identity verification
  • Contact details, email address, social media handles, and campaign performance metrics

Data Protection:

All data will be securely stored within India, and ACHWALE will not transfer data outside India. Data retention is limited to 15 days after account deactivation, following which data may be deleted in accordance with internal policies.

Important:

Creators are required to keep campaign posts live for a minimum of 30 days. Deleting posts within 48 hours without approval will result in a 50% penalty and may lead to account suspension.

7. PAYMENTS AND COMMISSIONS

Pay campaign amounts through ACHWALE's payment gateway

Creators

Receive 60%–70% of the campaign value within 24 hours of proof-of-work submission.

Partners

Receive 10%–15% commission after campaign completion

7A. MEMBERSHIP ACCESS & TASK AVAILABILITY

1. Membership plans provide access rights, not guaranteed task availability

Memberships purchased by Creators, Brands, or Partners provide access to specific platform features, dashboards, tools, and daily task limits. However, the purchase of a membership does not guarantee that tasks, campaigns, or brand opportunities will be available at all times.

2. Task and campaign volume may vary

Campaign availability depends on multiple external factors including brand activity, market conditions, campaign demand, creator niche, follower-tier selection, and timing of campaign launches. ACHWALE does not guarantee a fixed number of tasks per day, week, or month.

3. First-come-first-served acceptance model

Tasks and campaign slots are accepted by Creators on a first-come-first-served basis. A Creator may lose access to any task if they do not accept it immediately or if all slots for their follower tier have already been filled.

4. Creator Category Limitations

Some Creators may experience reduced task availability if their follower tier, niche, engagement rate, location, or platform type does not match the targeting criteria selected by Brands.

5. Execution frequency depends on external conditions

Some days may have fewer or no campaign opportunities, while other days may have high campaign volume. Variations in campaign availability do not constitute a service deficiency or grounds for refund.

6. Membership does not guarantee earnings

Earnings depend entirely on the Creator's ability to accept, execute, and submit approved campaign tasks. ACHWALE makes no representation or guarantee of minimum income, results, reach, engagement, or conversions.

7. User behavior affects task opportunities

A Creator may lose opportunities if they: log in late, fail to enable notifications, miss available task windows, submit low-quality proofs, violate campaign instructions, or have pending reviews or policy holds. These circumstances do not qualify for refunds or compensation.

8. Brand and Partner memberships operate similarly

Brand memberships allow unlimited campaigns but do not guarantee a specific number of Creator acceptances, execution rates, or performance outcomes. Partner memberships provide access to the achwale ecosystem but do not guarantee brand conversions, earnings, or commissions.

9. No Liability for Fluctuations

ACHWALE shall not be held liable for any loss, perceived value reduction, or unmet expectations arising from fluctuations in: creator availability, campaign volume, timing of campaign launches, brand demand for specific creator categories, or external algorithm or platform changes (Instagram, YouTube, etc.).

8. REFUNDS

Brands are eligible for a refund under the following conditions:

✅ Refund Eligibility:

  • If a campaign is rejected by ACHWALE due to non-compliance or violation of ethical standards
  • If selected Creators fail to participate, resulting in unexecuted slots after the campaign period

❌ No Refunds When:

Once a campaign is executed and performance tracking begins, no refunds are applicable.

⚠️ Content Restrictions:

ACHWALE reserves the right to reject or suspend campaigns promoting prohibited, offensive, or unlawful content, including but not limited to sexual, abusive, discriminatory, or misleading themes.

9. CONTENT OWNERSHIP AND RIGHTS

Creator Content

All campaign content created and posted by Creators remains their intellectual property.

Brand Assets

Brands retain ownership of their campaign creative assets.

Platform Rights

ACHWALE does not claim ownership of any content but reserves the right to moderate, remove, or restrict access to content that violates platform guidelines, laws, or community standards.

10. PROHIBITED ACTIVITIES

Users shall not:

Engage in misleading, fraudulent, or illegal campaigns

Use bots, scripts, or automation to manipulate engagement

Solicit payments or campaigns outside ACHWALE

Post defamatory, offensive, or prohibited content

Use ACHWALE for political or religious propaganda

⚠️ Consequences:

Violations may result in account suspension, blocking, or permanent termination.

11. LIMITATION OF LIABILITY

ACHWALE and KeTab Internet World shall not be held liable for any indirect, incidental, special, or consequential damages, loss of profits, data, or goodwill resulting from:

Delays or interruptions of service

Errors or omissions in content

Unauthorized access to user data

Disputes between Brands, Creators, or Partners

Maximum Liability:

The total liability of ACHWALE under any claim shall not exceed the total amount paid by the Brand for the campaign giving rise to the claim.

12. DISPUTE RESOLUTION

Arbitration

the matter shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, conducted in Hyderabad, India

Court Jurisdiction

The arbitration shall be presided over by a single arbitrator appointed by mutual consent

The arbitrator’s decision shall be final and binding. If arbitration fails, disputes shall fall under the exclusive jurisdiction of the courts in Hyderabad, India.

13. TERMINATION

ACHWALE reserves the right to suspend or terminate any User account if:

Fraudulent or misleading activity is detected

Payments are collected in ACHWALE's name outside the platform

!

Content guidelines or social media terms are violated

!

A Creator deletes campaign posts before 48 hours or repeats violations

⚠️ Consequences of Termination:

Termination may result in forfeiture of pending payments and legal action if necessary.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India, with exclusive jurisdiction of the courts in Hyderabad, Telangana.

15. MODIFICATION OF TERMS

ACHWALE reserves the right to amend or update these Terms at any time.

Effective Immediately

All updates will be effective immediately upon posting on the website or app

Continued Use = Acceptance

Continued use of the platform constitutes acceptance of revised Terms
